RANKED SERVER

Tripwire Interactive would like to thank you for submitting an application to operate a Ranked Red Orchestra 2: Heroes of Stalingrad (RO2) Server. In order to operate a Ranked RO2 Server you must review and agree to comply with the following Terms of Use (TOU). The operating of a Ranked RO2 Server is a privilege that Tripwire Interactive grants to Game Server Providers and trusted members of our player community. Ranked RO2 Servers enhance the quality of the gameplay experience for our players and we take that very seriously. The operation of a Ranked RO2 Server is subject to the terms of these TOU. These TOU are a binding agreement between you and Tripwire Interactive.

Please take the time to read through these TOU first because BY SETTING UP AND OPERATING A RANKED RO2 SERVER YOU ARE ACKNOWLEDGING THAT YOU HAVE READ THESE TOU, AGREE TO THEIR TERMS AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO, AND COMPLY WITH, THESE TERMS YOU MAY NOT OPERATE YOUR SERVER AS A RANKED RO2 SERVER.

1. RO2 Servers

There are two types of servers available for RO2.

Ranked RO2 Servers - Ranked RO2 Servers will allow players to gain stats, experience, and achievements. These servers will stick to the core gameplay of RO2 and will allow a limited amount of approved customization. The IP/Port of each approved Ranked RO2 Server will be integrated into the Approved Game Server List and each Ranked RO2 Server will be identified and be filtered as such in the RO2 server browser.

Unranked Servers - Unranked Servers will not allow players to gain stats, experience, or achievements. These servers can run any mod, mutator, map or configuration that they would like, and gameplay could differ greatly from the core Red Orchestra 2 gameplay. Players will still be able to play with all of their unlocked ranks and abilities on Unranked Servers, just not gain new ones.

These TOU apply only to Ranked RO2 Servers.

2. Ranked RO2 Server Hosting

Ranked RO2 Servers may be hosted in two ways, through an approved Game Server Provider (GSP) or through an independently operated Community Ranked RO2 Server.

a. Managed Ranked RO2 Game Servers - Once approved, a GSP becomes an Official GSP that may host and rent Managed Ranked RO2 Servers to players and clans. Each Official GSP must meet hardware and network criteria sufficient to provide a positive gameplay experience for players at the player counts offered. For example, if a GSP rents a 64 player Ranked RO2 Server, the server must be powerful enough to run 64 players without lag and there must be sufficient allocated bandwidth to the server. An Official GSP is responsible for ensuring server files are not modified or hacked to allow exploiting of ranking up. Those renting a Managed Ranked RO2 Server from an Official GSP need not submit a Ranked Server Application, though they are at liberty to do so.

b. Community Ranked RO2 Servers. Tripwire Interactive will also include trusted Community Ranked RO2 Servers on the Approved Game Server list.

3. The Application Process

In order to facilitate approved GPS Managed and Community Ranked RO2 Servers Tripwire Interactive has instituted the following process. An interested GSP or Community Ranked RO2 Server Administrator must fill out and submit a Ranked RO2 Server Request Form in the format provided by Tripwire Interactive to gain initial approval to operate a Community Ranked RO2 Server or to rent out GSP Managed Ranked RO2 Servers. All of the information requested in the form must be provided. The Request submission process includes an affirmation of the agreement to the terms of these TOU. Tripwire Interactive will then review the Request Form and determine if it meets its GSP Managed or Community Ranked RO2 Server criteria. Tripwire Interactive retains the sole discretion as to whether to grant Official GSP or Community Ranked RO2 Server status in response to a Request.

4. Ranked RO2 Server Requirements.

Permitted Server Maps, Modifications and Configurations.

While Tripwire Interactive encourages custom mods, maps and conversions of RO2 and fully supports its Mod community, we must limit the use of user generated mods, maps, configurations and mutations (“Customizations”) on our Ranked RO2 Servers. So, while we encourage Customizations, that's what the Unranked Servers are for. The Ranked RO2 Servers are for approved content and configurations only. We will do what we can to help GSP Managed and Community Ranked RO2 Server Administrators keep their Ranked RO2 Servers in compliance, but it is the GSP and Community Ranked RO2 Server Administrator's responsibility to make sure each Ranked RO2 Server remains in compliance at all times.

GSP Managed and Community Ranked RO2 Servers will run the commercially released version of RO2 in the default configuration. In addition, Tripwire Interactive will provide additional Whitelisted Maps, Mutators and limited Configuration adjustments that may be run on Ranked RO2 Servers. Whitelisted content and approved Configurations will be posted on the official RO2 web site (www.heroesofstalingrad.com) and updated from time to time. Again, it is the GSP and Community Ranked RO2 Server Administrator's responsibility to make sure the server remains in compliance at all times.

5. Commercial Exploitation.

Official GSP's may rent Managed Ranked RO2 Servers. Community Ranked RO2 Servers may not be used for any commercial purposes without the prior written consent of Tripwire Interactive (this limitation does not include the accepting of funds from individuals solely to pay rent for a server or to cover the hosting costs necessary to maintain a Community Ranked RO2 Server). Any other commercial exploitation of RO2 or Ranked RO2 Servers, without the prior written consent of Tripwire Interactive, is prohibited.

6. No Cheating or Server Hacking.

RO2 was made for gamers by gamers. In addition to any remedial action by Tripwire Interactive allowed under the RO2 End User License Agreement (EULA), any GSP Managed or Community Ranked RO2 Server determined to be hacking or exploiting the ranking systems will be removed from the Approved Game Server List. If too many Ranked RO2 Servers at an Official GSP are found to be hacking or exploiting the ranking system Tripwire Interactive may cancel the Official status of the GSP and remove all of its Ranked RO2 Servers from the Approved Game Server List.

Using or publicizing any server security holes may also subject a GSP to the immediate termination of the Official Status of a GSP and the deletion of a Managed or Community Ranked RO2 Servers from the Approved Game Server List. Tripwire Interactive may provide a GSP or Community Ranked RO2 Server Administrator with a Notice of Noncompliance and an opportunity to correct any Ranked RO2 Server that is not in compliance with these TOU, but is not obliged to so.

7. Limitation of Liability

UNDER NO CIRCUMSTANCES, INCLUDING WILLFUL ACTS OR NEGLIGENCE, SHALL TRIPWIRE INTERACTIVE OR ANY OF ITS OFFICERS, EMPLOYEES, DIRECTORS, AGENTS, LICENSORS, LICENSEES, SUBLICENSEE, SUPPLIERS OR ASSIGNS BE LIABLE FOR ANY INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF OR INABILITY TO USE ANY SERVER, EVEN IF SUCH PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF THOSE DAMAGES. THERE WILL BE NO LIABILITY FOR ANY LOST PROFITS, PERSONAL INJURY, EVEN SELF INFLICTED INJURY, OR FOR ANY INTENTIONAL TORT COMMITTED BY YOU OR ANY OTHER PERSON WHO PLAYS OR OBSERVES SOMEONE ELSE PLAYING RO2 ON ANY SERVER. In no event shall Tripwire Interactive's total liability to any player or server operator for any damages, losses, and causes of action (whether in contract, tort or otherwise) exceed the amount paid by that person or entity for RO2.

8. Controlling Law and Severability.

These TOU are governed by and construed in accordance with the laws of the State of Georgia, USA. Exclusive venue for all litigation related to these TOU will be in Fulton County, Georgia. If any provision of these TOU is determined to be unenforceable by a court or other tribunal of competent jurisdiction, such provision will be enforced to the maximum extent permissible and the remaining portions of these TOU will remain in full force and effect.

9. Complete Agreement.

These TOU constitute the entire agreement between the parties with respect to the operation of a GSP Managed or Community Ranked RO2 Server and related software. Tripwire Interactive reserves the right to modify the terms of these TOU from time to time and will post notice of all changes on the official RO2 web site (www.heroesofstalingrad.com).

10. Acceptance of Terms

By selecting the “I Agree” when submitting your Ranked RO2 Server Request application and operating a GSP Managed or Community Ranked RO2 Server, you agree to all of the terms of these TOU.
